UTILITY MODELS
A
Utility Model is all form, configuration or arrangement
of the elements of an artifact, tool, instrument,
mechanism or other object, or any of its parts,
that allows a better or different function, use
or manufacture of the object to which it is incorporated,
or that provides it with some utility, advantage
or technical effect, that it did not have before.
For an Utility Model to be registered it will
have to be new and have an industrial application.
A
Utility model will not be registered when it presents
minor differences with respect to previous inventions
or utility models, considering as minor differences
those that do not present any perceptible utilitarian
characteristic.
The
registration of Utility models will have an effective
period for ten years, which cannot be extended,
counted as of the date of filing of the application.
Payment
of registration fees for Utility Model
The
grant of a utility model is for a term of 10 years.
The first payment will be done at the moment of
filing the application and the next payment, after
five years counting from the date of filing the
application. The payment can be done at any moment
before the expiration of the respective quiquennial.
Our legislation will provide a grace period of
three months for the payment of register fees
for utility model, starting from the date in which
the fee payment should have been done.
