TRADEMARK/SERVICE MARK RENEWALS:

In order to obtain the renewal of a trademark or service mark, a petition must be filed before the Trademark Office within a year before the expiration date of the registration, along with the following document:

A Power of Attorney executed by the proprietor attested by a Notary Public, duly legalized by a Consul of Panama or by the Seal of Apostille.

There is a grace period of six (6) months after the expiration date of the registration, to request the renewal of the mark by paying an additional late fee of US$ 10.00 per month. During this grace period, the registration will maintain its full validity.


Use requirements for trademarks/service marks
Our Trademark Law does not provide a term to prove use after registration, however, the lack of use of a trademark for more than five consecutive years from the date of registration shall end in cancellation of the registration. Said cancellation may be requested by any person who considers to have the right to do so, in accordance with the procedure established for claims of opposition. It is important to mention that the concept of use, includes use in international and domestic commerce.
